Florida’s Supreme Court has declined jurisdiction over State of Florida v. Florida Workers’ Advocates, better known as the Padgett case. The push for Supreme Court review stems from a series of developments beginning back in June, when a three-judge panel from Florida’s 3rd District Court of Appeal unanimously reversed Miami-Dade Circuit Court Judge Jorge Cueto’s August 2014 ruling in the case. Judge Cueto had declared the state’s workers’ comp system unconstitutional because reforms had rendered it in an inadequate exclusive remedy. However, the Florida Supreme Court will be hearing at least three other workers’ comp cases in 2016, including Stahl v. Hialeah Hospital and Westphal v. St. Petersburg.
