The EEOC is scrutinizing pre-employment physical stress tests, in an effort to prevent discrimination against women. According to an EHS Today report, a national trucking company was using physical testing to rescind conditional employment offers to its truck drivers, even after the applicants had cleared medical certifications from the Department of Transportation authorizing them to drive. The company also allegedly had a policy preventing employees injured on the job from returning to work unless they were fully healed and had no work restrictions, which is illegal. The assessments are the basis for a suit filed in April claiming it is in violation of the Americans with Disabilities Act.
