A second bill requiring the Office of Workers’ Compensation Administration (OWCA) to establish a closed pharmacy formulary has been prefiled for the 2017 Regular Session which opens on April 10th. Representative Kirk Talbot (R-River Ridge) is sponsoring the legislation (HB592), which as opposed to Representative Chris Broadwater’s 2017 bill, does dictate that the Work Loss Data Institute’s “Official Disability Guidelines” formulary be adopted. Also unlike Broadwater’s bill, Talbot’s instrument gives specific dates for which legacy claims must conform to the new formulary. Under Talbot’s plan, the ODG formulary would apply to all claims on and after January 1st, 2018. Broadwater’s bill addresses legacy claims but does not give a date. Legacy claims would have to conform by July 1st, 2018. Both bills would further require that a variance procedure somewhat like that for the Medical Treatment Guidelines also exist.
