Risk & Insurance is reporting that two workers that helped clean up the 2010 BP oil spill can file claims, despite late filing. A class filed suit against BP several years ago, alleging that they were made ill by chemical exposure during cleanup. In January 2013, U.S. District Court Judge Carl Barbier approved the suit. Fabio Concepcion and Mickey Joseph Thibodaux were named parties in the class action suit, and BP chose not to mediate their claims after they filed a Notice of Intent. However, Concepcion and Thibodaux’s counsel never received that information. Barbier ruled on appeal that they are still eligible.
