The Louisiana Workforce Commission (LWC) and the Office of Workers’ Compensation (OWC) have issued a new statement in response to the full judgment in the 19th Judicial District Court case questioning the constitutionality of the medical review process. The statement reads in part: “The Louisiana Workforce Commission has received a judgment from District Judge Don Johnson of the 19th Judicial District Court preliminarily enjoining the Office of Workers’ Compensation medical director from reviewing medical treatment disputes for compliance with OWC’s treatment guidelines […] The LWC will seek a stay of the judgment and appropriate review by higher courts to keep this game-changing reform in place so that it can continue to benefit all stakeholders. In the interim, the agency will comply with the district court’s order. Pending further proceedings, OWC’s medical services section can no longer accept requests to review medical treatment disputes under La. R.S. 23:1203.1. Please check the agency’s website and social media frequently for further updates.”
