The National Conference of Insurance Legislators (NCOIL) has stated its intention to investigate “opt out” (or in the case of Texas, “opt in”) workers’ comp schemes. NCOIL decided at its annual meeting in November that, in light of increased national and popular scrutiny surrounding such programs and workers’ comp in general, it should perform a cost/benefit analysis of opt out approaches and to weigh in as needed on calls for federal intervention. According to the statement, the decision by the NCOIL Workers’ Compensation Insurance Committee to examine the issue in 2016 aligns with NCOIL’s commitment to promoting fair benefit systems and to protecting state insurance regulatory authority.
