A recent analysis of the workers’ compensation “opt-out” system in Oklahoma concludes that employer-run plans for injured workers can offer benefits that are equal to or better than those provided by traditional workers’ comp. However, the lack of guarantees for equal or better benefits means that some workers are left without adequate recourse. The analysis, by the International Association of Industrial Accident Boards and Commissions (IAIABC), cites the lack of consistency as the driving force behind a cache of constitutional challenges in Oklahoma since the state established opt-out.
