Tennessee is the latest state to consider opt-out legislation for workers’ comp. Senator Mark Green, a physician and Vice-Chair of the Senate Commerce and Labor Committee, and Representative Jeremy Durham, House Majority Whip, recently introduced the “Tennessee Option.” According to ARAWC, a national organization advocating for expanding opt-out on a state by state basis, “the Tennessee Option will be state-specific, drawing from the best practices of Texas nonsubscription and the Oklahoma Option. The key components of the Tennessee Option are: employee accountability, medical management, employee-employer engagement, and free-market competition.”
