The Texas Department of Insurance announced the public comment period for a rule which would amend death benefits eligibility to include spouses of first responders even after remarriage. According to a TDI alert delivered November 25th, the benefit changes would apply to remarried spouses “if the first responder suffered death in the course and scope of employment or while providing services as a volunteer.” Further associated amendments ( to Texas Labor Code 408.186 and 408.183) increase the maximum reimbursement for burial benefits payable in the workers’ compensation system from $6,000 to $10,000. These proposals, if they continue as written, will only apply to comp claims based on a compensable injury occurring on or after September 1st, 2015. The rules will be published in the December 4th addition of the Texas Register, according to TDI.
