Texas state Senator Jose Rodriguez of El Paso has already pre-filed a bill for the 2015 session which would require mandatory comp insurance for construction contractors in the state. Texas is the only state in the union that allows employers to “opt-out” of carrying workers’ comp insurance, though Oklahoma has also recently instituted an option aside from conventional coverage. The measure would also require subcontractors to carry workers’ comp.
