Attorneys representing claimants in Florida are calling NCCI’s nearly 20 percent proposed rate hike due to two recent Florida Supreme Court decisions affecting workers’ comp “ludicrous.” Both cases, Castellanos v. Next Door Co. and Westphal v. City of St. Petersburg were hotly anticipated and decided in favor of claimants. Speaking to WorkCompCentral, Mark Touby, president of Florida Workers’ Advocates, said that the new 19.6 percent rate hike proposed by NCCI (up from an initial 17.1 post-Castellanos) was evidence of the organization’s employer-focused bias and that the “fuzzy math does not compute.”
