A new bill moving through the Florida Legislature would allow insurers to independently research and file their own workers’ compensation insurance rates in the state – a move that would limit the long standing and strong influence of NCCI there. Senate Bill 1582, filed by Florida Republican Senator Rob Bradley, also has a provision that would allow judges in comp cases to award fees up to $250 an hour (depending on skill required and case complexity) to attorneys who represent injured workers. This latter portion of the bill is likely designed to address the Castellanos decision issued by the Florida Supreme Court last year, which struck down attorney fee limits and led to a 14.5 percent rate increase in the state.
