A new constitutional challenge to the Oklahoma opt-out legislation has been filed in the state Supreme Court. Bob Burke, seasoned claimant attorney out of Oklahoma who helmed the Duck v. Morgan Tire case last month invalidating the exclusive remedy over the “foreseeability” of a work injury, filed his writ on Friday.
