The saga of Florida circuit Judge Cueto’s decision in the landmark Padgett case, which declared the state’s comp system unconstitutional, continues with three amicus requests. The requests were submitted to the Florida 3rd District Court of Appeal by two claimant attorneys with Florida Workers’ Advocates (President Michael J. Winer and board member Geoffrey Bichler) and one attorney who specializes in appellate insurance defense work, Katherine E. Giddings. The 3rd district, which received the case after state Attorney General Pam Bondi appealed Cueto’s ruling, has not yet decided whether it will pass the question directly to the Supreme Court despite the fact that it accepted the briefs.
